Wage and Hour

New Jersey Wage and Hour Disputes

Both the state of New Jersey and the U.S. federal government have laws that govern wage and hour disputes. At the Law Offices of Kevin M. Costello, we will guide you through the maze of government regulations and file claims against employers who violate these laws. Contact us to speak to a lawyer about filing a wage and hour claim against your employer.

Wage and hour claims are very complex and can be challenging for a person who is unfamiliar with state and federal laws. For over sixteen years, our firm has represented people in two types of wage and hour claims. We represent employees who are refused overtime because the employer claims that certain exemptions apply as well as employees who are refused overtime because the employer claims that it was not earned.

New Jersey Wage and Hour Law

While similar to the federally enacted Fair Labor Standards Act, New Jersey State Wage and Hour Laws have certain unique provisions. Effective October 1, 2006 the minimum wage in New Jersey is $7.15 per hour. Employers must pay time and half for certain employees who work over forty hours per week.

Fair Labor Standards Act (FLSA)

The Fair Labor Standards Act is the federal statute that governs wage and hour disputes between employers and employees. We file claims against employers who violate federal laws related to:

  • Exempt and Non-Exempt Employee Status
  • Overtime Pay
  • Minimum Wage
  • A Fringe Benefit
